PART A - Mimar AI Features: Additional Terms

Last Updated: November 01, 2026

1. Scope and order of precedence

These additional terms (“Mimar Terms”) apply to your use of Mimar, Buildend’s AI assistant, and to any AI-powered features, tools or capabilities we offer now or add in the future, including chat, voice, email intake and report generation (together, the “Mimar Features”), unless a feature comes with its own terms.

2. What Mimar does

Mimar uses artificial intelligence to answer questions about, summarize and prepare changes to project information you already have access to in Buildend, such as RFIs, submittals, tasks, change orders, budgets, schedules, contracts, forms and documents, and to generate reports. Mimar may also prepare new records, such as an RFI drafted from a forwarded email or a dictated form, but only as described in Section 5. Buildend may decide what Mimar can and cannot do, and does not promise that any particular capability will be available. Mimar’s capabilities, the information it can access, and the actions it can prepare may change over time as we add or change features.

3. Enabling Mimar; Customer responsibilities

Mimar is available only for Workspaces where it has been enabled. The person enabling Mimar represents that they are authorized to accept these Mimar Terms for the Customer, and the Customer is bound by them. The Customer is responsible for: (a) its users' use of Mimar; (b) configuring user roles and permissions correctly, since Mimar follows those permissions; (c) any Workspace-wide instructions its administrators set; (d) telling its users that Mimar is available and how it handles information; and (e) obtaining any consents and notices required by law for the people whose information is submitted to Mimar. The Customer may disable Mimar at any time in Workspace settings or by contacting support.

4. AI outputs: you must review them

  • Outputs can be wrong. Mimar is generated by AI models that can produce inaccurate, incomplete, outdated or misleading results, including incorrect figures, dates, summaries and citations of project records.
  • You decide and you are responsible. Mimar is a productivity tool. It does not provide engineering, architectural, legal, accounting, safety or other professional advice, and it does not replace professional judgment or the project's contract documents. The contract documents control over any Output.
  • Verify before relying. You must review Outputs before relying on them, sending them to others or acting on them, particularly anything affecting cost, schedule, safety, or contractual rights and deadlines such as RFI responses, change orders, payment applications and notices.
  • No reliance on Buildend. Buildend is not responsible for decisions made, or actions taken or not taken, based on Outputs. Outputs may be similar or identical across users, and Buildend does not guarantee that Outputs are original or free of third-party rights.

5. Actions taken through Mimar

  • Your permissions apply. Mimar can read or change only what the requesting user could read or change in Buildend. It does not grant additional access, and the Customer is responsible for those permissions being set correctly.
  • Changes require approval. Before Mimar creates or changes a record, it shows the proposed action for the user to approve or reject. Nothing changes unless the user approves. Buildend may rely on an approval as the user's own instruction, and the user and Customer are responsible for any action approved, as if the user had made the change directly.
  • Email intake. If your Workspace forwards project email to a Mimar inbound address, Mimar may prepare a draft record from it for your review. Nothing is created until someone on your team approves it. Approved records are attributed to the sender, if a recognized project member, otherwise the user designated for that project's inbox. The Customer is responsible for having the right to forward and process that email, including any third-party content in it, and for reviewing drafts for accuracy before approving them.
  • Reports. Reports Mimar generates are saved as files in the relevant project and are subject to that project's access controls.

6. Your content

  • Ownership. As between you and Buildend, you keep your rights in the information you submit to Mimar and the project data Mimar accesses ("Inputs"). Subject to these terms, applicable law and third-party rights, you may use the responses Mimar generates for you ("Outputs"). Buildend makes no promise that Outputs are protectable or owned by anyone.
  • License to Buildend. You grant Buildend and its service providers a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit and display Inputs and Outputs to provide, secure, support, maintain and improve the Mimar Features, to comply with law, and to enforce these terms, in each case as described in the Privacy Policy.
  • De-identified data. Buildend may create and use usage, performance and aggregated or de-identified data about how Mimar is used, and may retain and use it for any lawful business purpose, provided it does not identify you, your Workspace or any individual.
  • Your promises. You have, and will keep, all rights, consents and permissions needed to submit Inputs and to let Buildend process them as described here. You will not submit Inputs that infringe or violate others' rights or any law.

7. Acceptable use

In addition to the acceptable-use rules in the Terms, you will not, and will not allow anyone else to: (a) attempt to extract, reverse-engineer or bypass Mimar's instructions, safeguards, usage limits or permission checks, including by prompt injection; (b) use Mimar to generate content that is unlawful, deceptive, harassing or that facilitates harm; (c) use Mimar as the sole basis for decisions involving life safety or structural integrity; (d) use Mimar or its Outputs to build, train or improve a competing AI model or service; (e) submit sensitive personal information, such as government ID numbers, financial account numbers or health information, unless necessary for your project and permitted by law; (f) use automated means to access Mimar except through interfaces Buildend provides; or (g) present Outputs as professionally certified. Buildend may suspend or restrict Mimar access at once, with or without notice, if it believes these rules are broken or to protect the Services or other customers.

8. Voice input

If you use voice, your device's operating-system speech service converts speech to text. Depending on your device and settings, that service may send audio to its provider, such as Apple or Google, under that provider's terms, which Buildend does not control. Buildend receives the resulting text, not the audio. You can switch to typing at any time. You are responsible for having any consent needed to record others' speech.

9. Feedback

Mimar lets you flag a response as good or wrong and add a comment. In these terms, "Feedback" means the flagged exchange (your message, Mimar's reply, and the surrounding messages we store for context), your comment, and any suggestion or idea you share about Mimar or other Buildend products.

  • Broad license. You grant Buildend a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully paid-up, transferable and sublicensable (through multiple tiers) license to use, reproduce, store, modify, adapt, create derivative works from, publish internally, and otherwise exploit Feedback for any purpose related to developing, testing, evaluating, securing, marketing and improving Mimar and Buildend's products and services. Buildend may de-identify or generalize Feedback and may convert it into instructions, examples, test cases and evaluations.
  • No obligation. Buildend need not use Feedback, act on it, respond to it, keep it confidential or pay for it. You waive any claim to compensation or credit.
  • Deleting a conversation does not withdraw Feedback. Feedback already submitted, and anything derived from it, may be kept and used as described above even if you later delete the conversation or the Workspace ends.
  • Your responsibility. Flag an exchange only if you have the right to share it with Buildend on these terms. Do not add confidential information to a comment beyond what is already in the flagged exchange.
  • Privacy. Our handling of personal information in Feedback is described in Part B §6 of the Privacy Policy.

10. Availability, third-party services and changes

Mimar depends on third-party AI and infrastructure providers and may be unavailable, slow, inaccurate or limited at times. Buildend may add, change, limit, suspend or discontinue any Mimar Feature or provider at any time, and may apply or change usage limits described in your plan. Features marked beta or preview are provided as-is, may change or be withdrawn at any time, and are not covered by any service commitment. No credits or refunds are owed for Mimar being unavailable or changed.

11. Disclaimers, liability and indemnity

THE MIMAR FEATURES AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, BUILDEND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THAT OUTPUTS WILL BE ACCURATE, COMPLETE, RELIABLE OR FIT FOR A PARTICULAR PURPOSE, AND ANY WARRANTY OF NON-INFRINGEMENT. The disclaimers, exclusions and limitations of liability in the Terms apply to the Mimar Features. To the fullest extent permitted by law, Buildend's total liability arising from the Mimar Features will not exceed the fees you paid for the Services in the 12 months before the event giving rise to the claim. You will defend and indemnify Buildend against third-party claims arising from your Inputs, your forwarded email, your approval of actions, or your breach of Sections 6 or 7, to the extent permitted by law.

12. Suspension, termination and survival

Buildend may suspend or end your access to Mimar at any time, including for breach or to protect the Services. Sections 4, 6, 9, 11 and this Section 12 survive termination or expiry.

13. Changes to these Mimar Terms

Buildend may update these Mimar Terms at any time. Updates take effect on the date stated in the update. For material changes we will give notice by email to Workspace administrators and/or in the app. Continued use of Mimar after the effective date means you accept the update.
